Daugherty’s article in Insurance Journal covers court rulings conflicting with Missouri statute’s intent to give insurers right to intervene

Seyferth Blumenthal & Harris LLC (SBH) attorney Nick Daugherty recently authored an article published with Insurance Journal, considered the most-read national property and casualty publication for independent insurance agents and brokers.

In the article, Daugherty discusses two separate recent rulings in the Missouri Court of Appeals that seem to effectively strip any practical effect from a Missouri amendment meant to provide protections to insurers. Specifically, insurers are potentially unable to guarantee a right to intervene in a court arbitration proceeding involving the insured.

The applicable statute was amended to provide the insurer written notice of any agreement related to claims for damages and to give 30 days for intervention before a judgment could be entered, potentially exposing the insurer to damages beyond the policy limits.
