Federal Jury Finds in Favor of SBH Client in Title VII Harassment Case

Seyferth Blumenthal & Harris LLC is pleased to announce that a federal jury sided in favor of client Sun Chemical Corporation in a lawsuit brought forward by the U.S. Equal Employment Opportunity Commission (EEOC). The EEOC filed the lawsuit in the United States District Court for the Western District of Missouri.

The EEOC alleged that a technician at Sun Chemical was called a racial slur and physically intimidated by a co-worker during an altercation at a manufacturing site in October 2019. The EEOC claimed that the company failed to prevent racial harassment from occurring in in the workplace and that the co-worker’s actions could be considered severe enough to create a racially hostile work environment. Sun Chemical maintained that the incident was promptly investigated and appropriate corrective action was taken after the incident to stop further problems from occurring.

On December 11, 2024, at the conclusion of the trial, jurors returned a unanimous verdict, finding that Sun Chemical was not liable for racial harassment under Title VII of the Civil Rights Act of 1964.
