Haddad, Daugherty author Insurance Journal article on appeal ruling related to an insurer’s limited right to intervene on settlements

Seyferth Blumenthal & Harris LLC (SBH) attorneys Mark Haddad and Nick Daugherty recently co-authored an article published with Insurance Journal, considered the most-read national property and casualty publication for independent insurance agents and brokers.

Haddad and Daugherty look at the Western District of the Missouri Court of Appeals’ recent ruling in Knight v. Knight that continued to construe the effect of the 2017 amendments to Mo. Rev. Stat. § 537.065, which gave insurers a limited right to intervene when their insured enters into a settlement agreement pursuant to the statute. According to the decision, insurers must be notified of the 537.065 Agreement “before a judgment may be entered” but does not provide an insurer an opportunity to intervene before the insured’s liability or damages are determined.
