Tenth Circuit affirms ruling in favor of Liberty Mutual in ‘black lung’ case

Law360 recently featured Seyferth Blumenthal & Harris LLC (SBH) attorney Bruce Moothart in an article covering a recent ruling in Liberty Mutual Fire Insurance v. Woolman, et al.

The Tenth Circuit Court affirmed last week a lower court ruling that Liberty Mutual didn’t breach obligations to the former president of a now-bankrupt coal company, which claimed a failure to provide a policy with coverage for “black lung” claims. Liberty Mutual was found to have no obligation to the executive making the claim.

Moothart and Charlie Harris, Jr. of SBH represented Liberty Mutual at trial and on appeal. “We felt all along that the district court ruled correctly and are pleased that the Tenth Circuit confirmed that,” Moothart told Law360 in an article that can be read at this link (subscription required).

Moothart’s practice at SBH focuses on the representation of businesses and professionals in complex litigation with an emphasis on insurance-related issues. An accomplished trial lawyer, he has represented clients in lawsuits in more than 20 states and has taken cases to trial in seven states.

In addition, Moothart has extensive experience in representing policyholders and insurers in coverage-related cases and has counseled clients and represented them in litigation in hundreds of such matters.
